Terms of Service

1. Who we are

Cadera ("the Service") is operated by R Brands LLC, a limited liability company registered in Delaware, United States ("we", "us", "our").

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service is, and what it is not

The Service is analytical software. It takes assumptions you enter about a property and calculates projections from them.

The Service does not provide investment, financial, tax, legal or real estate advice. Nothing produced by the Service is a recommendation to buy, sell, finance or refinance any property. We are not a broker, dealer, investment adviser, mortgage lender, appraiser or tax preparer, and no fiduciary relationship is created by your use of the Service.

Every figure the Service produces is a projection derived from assumptions you supply. Projections are not predictions. Actual results will differ, often materially. You are solely responsible for verifying every input, for the decisions you make, and for obtaining professional advice appropriate to your circumstances.

Depreciation, tax and basis figures are estimates for planning only and are not tax advice. Consult a qualified tax professional before relying on them.

3. Your account

You must be at least 18 and provide accurate registration information. You are responsible for keeping your credentials secure and for all activity under your account. Tell us promptly at support@caderarealestate.com if you believe your account has been compromised.

4. Plans, billing and cancellation

Free tier. Free accounts may create up to five saved analyses. We may change this limit with notice.

Paid subscriptions. Paid plans are billed in advance on the interval you select at checkout (monthly, three-monthly, six-monthly or annual). Payment is processed by Stripe; we do not store your card details.

Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current rate, unless cancelled before the renewal date.

Cancellation. You may cancel at any time from your account settings. Access continues until the end of the paid period. See the Refund Policy below.

Price changes. We may change prices. Changes take effect at your next renewal and we will give at least 30 days' notice by email.

5. Your content

You keep ownership of everything you enter: property details, financial assumptions, photographs, notes and generated analyses ("Your Content").

You grant us a limited license to store, process and display Your Content solely to operate the Service for you. We do not sell it, and we do not share it with third parties except the service providers listed in the Privacy Policy.

You confirm you have the right to upload anything you upload, including photographs.

6. Our content

The Service, including its software, calculations, methodology, text, design and branding, is owned by us and protected by intellectual property law. You may not copy, reverse engineer, resell or create derivative works from it.

Reports you generate are yours to use, including commercially. You may share them with lenders, partners and advisers.

7. Acceptable use

You may not: use the Service unlawfully; attempt to gain unauthorized access to any part of it or to another user's data; scrape, bulk-extract or resell its output as a competing service; interfere with its operation; or share your account credentials.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend it for maintenance, and we may change or discontinue features.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, that calculations will be free of defects, or that any projection will prove accurate.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR INVESTMENT LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED US DOLLARS.

This applies regardless of the legal theory and even if we were advised such damages were possible. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

11. Indemnity

You will indemnify us against claims arising from your use of the Service, your breach of these Terms, or decisions you or others make based on analyses you produce.

12. Termination

You may close your account at any time. We may suspend or terminate accounts that breach these Terms. On termination your right to use the Service ends; data handling is described in the Privacy Policy.

13. Changes

We may update these Terms. Material changes will be notified by email or in the Service at least 30 days before taking effect. Continued use after that constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Disputes will be resolved in the state or federal courts located in New Castle County, Delaware, and both parties consent to the personal jurisdiction of those courts.
